Share with Oscar Pty Ltd (referred to as “Oscar,” “we,” “us” or “our”) respects your privacy and is committed to protecting your privacy online. This document (the “Privacy Policy”) explains the practices and rules concerning the collection of your personal information and how we use information that we have collected from and about you.
This Privacy Policy applies to the parking services (“the Services”) provided through the Oscar Website located at https://www.sharewithoscar.com.au (the “Website”) and Oscar mobile applications (“Application”) made available by Oscar to deliver the Services. It does not apply to the practices of other companies that Oscar does not own or control nor does it apply to information of any kind provided to Oscar by advertisers or other business partners. Links to other websites are governed by their own policies.
If you do not accept this policy, you should discontinue using the Application and Oscar’s Services.
We refer to two types of user information in this policy: Personally Identifiable Information (“Personal Information”) and non-Personally Identifiable Information.
Personally Identifiable Information refers to any information that can be used to uniquely identify, contact, or locate you. Examples include a name, physical address, e-mail address, telephone number, or a credit card number.
Oscar collects only the Personal Information that you voluntarily provide to us, such as when you register to use the Services, set up a profile, create content, sign up for an offer, complete a survey or provide feedback. If you purchase the Services, you might also be asked to provide your driver’s license, credit card and related information for verification and billing purposes.
You might also be asked for, or choose to provide, additional information about yourself that does not, itself, specifically identify you. This is non-Personally Identifiable Information. However, some information of this kind, such as your age, gender, geographic location and shopping preferences may be required (or merely requested) when you register for the Services, and may be associated with your Personal Information.
If you decide to register through or otherwise grant access to a third-party network or Integrated Service such as Facebook or Google, Oscar may also collect Personal Information that is already associated with your Integrated Service account. You may also have the option of sharing additional information with Oscar through an Integrated Service. If you choose to provide such information, during registration or otherwise, you are giving Oscar the permission to use, share and store it in a manner consistent with this Privacy Policy.
Oscar may also automatically collect other types of non-Personally Identifiable Information as you use the Services, including technical information (such as your IP address, mobile device ID, or browser type) and usage information (such as location data, preferred language, the parts of the Services you have visited, which links you have clicked and other information about how you interact with the Services). This information is anonymous, and is not associated with your Personal Information, although it may be associated with other pieces of anonymous information about you.
We may collect information about your movements throughout our Website or Application. For example, we can identify the pages on our website that your browser requests or visits. This information can only identify you as an individual if you have chosen to identify yourself, for example, by registering on our Website.
There are certain situations where it will be necessary for Oscar to disclose some of your personal information to the Host or Guest. As a Host, when your Parking Spot is booked by a Guest, your address will be displayed to the Guest so that the Guest can navigate to the Parking Spot. After the Booking has ended, the Guest will no longer have access to your address.
We may, at our discretion, further disclose your personal information if we deem it necessary for the provision of the Services or if a dispute arises between the Host and Guest (for example, where the Host suffers damage to the Parking Spot or the premises on which the Parking Spot is located).
Oscar does not sell or trade your Personally Identifiable Information to outside parties. We may disclose your Personally Identifiable Information to vendors who help us operate the Website or Application, conduct our business or provide the Services to you, such as credit card processors, customer service centres, or e-mail marketing providers. All such partners are obligated to keep your information confidential.
We may disclose Personally Identifiable Information, including to local, state, or federal law enforcement officials, when we believe in good faith that the law requires such action, or when required to do so by order of a court or other compulsory legal process. We may also share Personally Identifiable Information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or to prevent harm to the Website or Application.
Where legally required or permissible according to applicable law, we may disclose personally identifiable information to relevant tax authorities or government agency. From 1 July 2024, Share with Oscar is required to comply with the rules of the Sharing Economy Reporting Scheme (SERR) and this involves reporting certain information about your transactions, earnings and personal/business information to the Australian Tax Office (ATO). This information will be reported to the ATO twice a year and includes information such as your transactions, earnings, and fees incurred on Share with Oscar as well as full name, primary address, contact details, date of birth, ABN and GST (if applicable). By using our platform and services, you acknowledge and agree to Share with Oscar providing this information and any other legally required information under the SERR to the ATO or associated government agency.
We may transfer your Personally Identifiable Information if we are acquired by or merge with another company. We will notify you in accordance with the procedures contained in this Privacy Policy if your information will become subject to a different privacy policy.
We may use or distribute information about you and your use of the Services in ways that do not reveal Personally Identifiable Information. For example, we may share anonymous user information with advertisers and advertising networks to enable the display of targeted, relevant advertisements. We may also provide anonymous usage data or summary characteristics of our audience to potential partners and advertisers or post such information on publicly accessible areas of the Website.
We may disclose personal information outside of Australia to third party providers located in other countries.
